What is Quiet Enjoyment ?
Quiet enjoyment is a term from the Strata Titles Act of WA and often referred to by Strata Managers and the strata industry as a whole.
Quiet enjoyment sees that all owners, occupier or other resident(s) and their guests shall use and enjoy the common property and their lot so as to not unreasonably interfere nor cause a nuisance to other proprietors, occupiers or residents, or of their visitors’ enjoyment.
The right to quiet enjoyment is not only a right to use premises but also to enjoy the premises. see Schedule 1 By Law 2
SAT ruling which sees dog removed from the strata complex as occupants of the strata complex have the right to reasonable quiet enjoyment of their lots and the common property.
